We may amend this Agreement at any time by posting a revised version on our website. The revised version will be effective at the time we post it. In addition, if the revised version includes a Substantial Change, we will provide you with 30 Days' prior notice of any Substantial Change by posting notice on the Policy Updates page of our website.
This is an important document which you must consider carefully when choosing whether to use the Bumeno Services. Please be advised: This Agreement contains provisions that govern how claims you and we have against each other are resolved. It also contains an Agreement to Arbitrate, which will, with limited exception, require you to submit claims you have against us to binding and final arbitration, unless you opt out of the Agreement to Arbitrate by the later of December 2, 2014 or 30 Days after the date you accept the User Agreement for the first time. Unless you opt out: (1) you will only be permitted to pursue claims against Bumeno on an individual basis, not as a plaintiff or class member in any class or representative action or proceeding, and (2) you will only be permitted to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis.
Please note the following risks of using the Bumeno Services, which are set forth in more detail in the relevant sections of this Agreement:
Payments received in your Account may be reversed at a later time, for example, if such a payment is subject to a Chargeback, Reversal, Claim or is otherwise invalidated. This means that for some of our Sellers, payments received into their Account may be returned to the sender or otherwise removed from their Account after they have been paid and/or delivered any goods or services sold.
If you are a Seller, you can help protect yourself from the risk of a payment being reversed from your Account by following the criteria set out in the Protection for Sellers (If you are sent an unauthorized payment (for example, from a hacked account), or a buyer claims they never received their item, our Seller Protection covers you for the full amount of the payment on eligible sales.Seller Protection covers tangible items that are sold and shipped (with proof of delivery, see below for details) from within the United States. You'll still get Seller Protection if your buyer is outside the US. To ensure you're protected, ship to the address that the buyer specifies during checkout. Also, we recommend that you ship the item within 7 days of receiving payment.So, what's proof of delivery? Basically, it's documentation (physical or electronic) from your shipping company. It should include: the date the item is shipped, the recipient's address, the item's status as delivered, and the date of delivery.Seller Protection does not cover certain kinds of situations. You're not protected if the item you ship doesn't match your description. Seller protection also doesn't cover the sale of services, intangible items, digital goods, or items that violate our policies or eBay's policies (stuff that's usually prohibited by law anyway). Seller Protection also doesn't cover items you sell or deliver in person.) We may close, suspend, or limit your access to your Account or the Bumeno Services, and/or limit access to your Balance for up to 180 Days (or longer if pursuant to a court order or other legal process) if you violate this Agreement, any other agreement you enter into with Bumeno, or as otherwise specified in this Agreement or other agreement you have entered into with Bumeno. We may also use proprietary fraud and risk modeling when assessing the risk associated with your Account. If you wish to open a Dispute through Bumeno's Online Resolution Center, you must do so within 45 Days of making your payment or initiating your transaction in the case of Pay After Delivery.
